If you are using the Services on behalf of an educational institution, you represent that you are authorized to accept these Terms on behalf of that institution.

2. Eligibility

The Services are intended for use by authorized representatives of schools, districts, and educational institutions. Use by individuals under 13 years of age is only permitted through accounts established by educational institutions in compliance with applicable laws.

3. User Accounts

Authorized users may be provided accounts to access the Services:

• You are responsible for maintaining the confidentiality of your login credentials.
• You agree to provide accurate information and to promptly update your account details as needed.
• You are responsible for all activity that occurs under your account.

4. Permitted Use

You agree to use the Services only for lawful educational and administrative purposes consistent with your institution’s policies and all applicable laws and regulations. You shall not:

• Attempt to reverse-engineer, decompile, or exploit the Services
• Circumvent any access restrictions or security measures
• Use the Services to transmit unlawful, abusive, or defamatory content

5. Ownership and Intellectual Property

All software, content, and materials provided by Better Choices Education LLC are owned by or licensed to us and are protected by copyright, trademark, and other intellectual property laws. No rights are granted except as explicitly stated.

6. Privacy and Student Data

Use of the Services is also governed by our Privacy Policy and Student Data Privacy Policy,which outline our handling of personally identifiable information and compliance with the Family Educational Rights and Privacy Act (FERPA), applicable state student data privacy laws, and other relevant federal and state regulations.

7. Service Availability and Modifications

We strive to maintain uninterrupted access to our Services but do not guarantee uptime or availability. We may modify, suspend, or discontinue portions of the Services at any time without liability.

8. Termination

We reserve the right to suspend or terminate access to the Services for violation of these Terms or any applicable laws. Upon termination:

• Your access credentials will be disabled
• All associated student data will be handled per the Data Disposition Policy and applicable contracts

9. Disclaimers and Limitation of Liability

The Services are provided “as is” without warranty of any kind. We do not warrant that the Services will meet your requirements or operate uninterrupted. To the fullest extent permitted by law:

• We disclaim all warranties, express or implied
• We are not liable for any indirect, incidental, or consequential damages arising out of or related to your use of the Services

10. Governing Law

These Terms shall be governed by and construed in accordance with applicable federal law and the laws of the state in which the subscribing educational institution is located, without regard to conflict of laws principles. Where no specific state law applies, the laws of the State of Delaware shall govern.

11. Changes to Terms

We may revise these Terms from time to time. Material changes will be communicated through the Services or via email. Continued use after changes constitutes acceptance of the new Terms.
